If a painter created an original oil painting of his family and included the Disney character Tinkerbell as a family member, his use of Tinkerbell would be fair use because of it's the fact that the artist considers Tinkerbell a member of his family. The use of Tinkerbell in the painting is fair use because he made the painting and Disney did not, and the painting could be called a derivative work.

Disney, of course, owns ABC. Back in March , ABC aired a two-hour movie Tilted: The Last Days of Michael Jackson. The Michael Jackson Estate was not happy for the fact they have not asked to use the content for the movie . They sued Disney for stealing property without permission from The Michael Jackson Estate.
